PRIVACY POLICY
The mobile app called Wayo® (the “App”) is intended to enable people who are physically located in the United States to find and share entertainment venues, events and properties that they might like based on recommendations by friends. This privacy policy describes the personally identifying information (“PII”) and other information that is collected when you use the App, how that information is used, and with whom it is shared.
The App is provided by Wayo, Inc., a Delaware corporation with a business address at 99 Wall Street, #389, New York, NY 10005 (“Wayo” or “we”). To maintain and operate the App, we work with various third-party service providers (“Service Providers"). Service Providers include vendors and suppliers that provide us with technologies, services and/or content for the App, updating the data in the App, analyzing the operation of the App (“Analytics”), advertising and marketing, and customer services.
PII that is collected when you use the App
· PII that you provide to us directly. To use the account-specific features of the App, you must create an account. To create an account, you must provide your name, your email address, birthday, and gender.
· PII that we may receive from third parties. We may receive PII and other information about you from third parties. For example, if you access the App by “following” or “liking” the App, or linking the App to a third-party site, that third party may pass certain information about your use of its service to us. Such information may include the user ID associated with that account (such as your Facebook® I.D.), an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to the App.
Other information that is collected when you use the App
· Device identifiers. When you access the App through your phone, tablet or other mobile device (each, a “Mobile Device”), we and our Service Providers may access, collect, monitor and/or remotely store information about your Mobile Device, including the hardware model, operating system and version, unique device identifier, browser type and language, serial number, mobile device phone number, and mobile network information (collectively, “Device Identifiers”).
· Location data. When you access the App through your Mobile Device, we and our Service Providers may access, collect, monitor and/or remotely store “Location Data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your Mobile Device. Location Data may convey to us information about how you browse and use the App as well as your current location. If you enabled location tracking when you launched the App, you can review or change your setting later on your Mobile Device.
· Device state information. When you access the App through your Mobile Device, we and our Service Providers also may access device state information and information about how the App functions on your Mobile Device.
· Other information. We collect other information through our use of cookies and other technology. Below you can read how those technologies work, what information we use them to collect and how we use it.
Cookies and the information they collect
• What cookies are. A “cookie” with respect to a mobile app is a small data file that the app stores when you use the App. A cookie file can contain information such as a unique ID that the App uses to track the section of the App that you visited and is a standard method of registering user preferences. These preferences are stored in a file on your Mobile Device.
• What they do. “Session” cookies last for a relatively short period of time, such as the duration of one “session” of your using the App. By contrast, “persistent” cookies remain on your Mobile Device for a longer period of time and may remain on your Mobile Device until you erase them. Cookies make it easier for you to use the App by enabling you to access your information when you "sign in" to your account and move uninterrupted between areas of the App.
● How you can control cookies. You can set the browser on your Mobile Device to accept all cookies, to reject cookies, or to notify you whenever a cookie is offered so that you can decide each time whether to accept it. Rejecting a cookie, however, may preclude you from using, or may negatively affect the display or function of, the App or certain areas or features of the App. To learn more about cookies, including how to enable cookies, change your browser settings and find and delete cookies on your hard drive, please refer to your browser's help menus or visit www.allaboutcookies.org.
Beacons and the information they collect
● We may also use an application known as a "beacon." A beacon is an electronic file that usually consists of a single-pixel image that is used in combination with a cookie or cookies. Beacons work in tandem with mobile apps to trigger particular messages or actions based on rules, such as triggering a push notification when a user is within a certain distance from a beacon.
Use of PII and other information
· To send you service and promotional information. We and our Service Providers may use your email address and other information we collect or receive through the App to send you reminders, changes/updates, and technical and security notices related to the App, and promotions and special offers related to the App or other products and services, by emails or push notifications to your Mobile Device.
● To help you find restaurants and bars. Your searches, filters, and other activities within the App will indicate the kind of restaurant or bar you may be looking for, what aspects of restaurants or bars may be important to you, and/or in what geographical location you may want to find a restaurant or bar. Based on that information, we may provide you with information about restaurants and bars that are similar to or located near a restaurant or bar you have looked at or are looking at, information about restaurants and bars and points of interest in the geographical area in or from which you are using the App (such as a notification about a bar near you that is offering a deal on drinks), and other customized information that we think may be useful to you in your search for a restaurant or bar.
● To help you find movies, TV, and other entertainment. We may also use your searches, filters and other activities within the App to help you identify entertainment that you might like, such as TV shows and movies.
● To facilitate use of the App. We and our Service Providers use information we collect through cookies to (i) remember you so that you will not have to log in each time you use the App, (ii) help you efficiently access your information after you sign in, (iii) keep track of preferences you specify while visiting the App, (iv) compile aggregate metrics such as total number of users, traffic, demographic patterns, and user behaviors related to the use of the App, such as restaurants and bars or entertainment properties added to favorites, iv) diagnose or fix technology problems, (vi) solicit your feedback about crashes, fixes and updates and invite you to beta test updates of the App, and (vii) automatically update the App on your Mobile Device.
● To offer you ads targeted to your interests. We may use cookies and other tracking technologies, such as Google® remarketing tags, to enable us and our advertising partners to deliver advertisements on the App and on third party sites that are relevant to you and your interests based on your account information, content browsing activity, use of the Services and in some cases, other information about you that we or our advertisers have obtained from other sources. So, for example, if you have used the App in the last thirty days, you might be online and see an ad for a particular restaurant or movie that you favorited in the App.
Disclosure and sharing of PII and other information
· Service Providers. We may provide your PII and other information that we collect to our Service Providers. Our Service Providers’ access to your PII is limited to the information reasonably necessary for them to perform their limited functions.
· Restaurants and bars. We may share data about how people use the App with restaurants, bars, other entertainment venues and content providers, and with companies that provide data to those service providers. The data we share may include information related to age or gender (for example, men aged 25-30 like to hang out in sports bars and enjoy particular series), and we may share your birthday so that restaurants, bars, and other entertainment service and content providers can send you promotions on or around your birthday, but we will not share any other PII or any other information that would enable anyone to identify you or any other individual user.
· Social media sites. As we describe in our cookie policy, we may include social widgets within the App. Such widgets enable you to interact with the associated social media services. These widgets may collect browsing data which may be received by the social media services that provided the widgets and are controlled by such social media services. As a result, you may see ads for the App while you are on such social media services.
· By third parties. Third parties such as Twitter (if you use it to log in) may disclose aggregate end-user data.
Disclosure for legal reasons
· We may disclose your PII and other information if we believe that it is reasonably necessary to comply with a law or regulation or judicial or administrative order, to protect the safety of any person, to address fraud, security or technical issues, or to protect Wayo’s rights or property. However, nothing in this privacy policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your PII.
· If Wayo is acquired by or merged into another company, or if the App is sold to another company, we will make that information available to that company to use in the ways described above, to enable it to continue the business of operating the App.
Opting out of collection of your information for tracking and advertising
● Check the settings on your Mobile Device to see whether and to what extent you can delete or disable tracking mechanisms. Disabling cookies and/or other tracking tools may disable some of the features available on the App.
● One of the programs we use to collect information that is not PII is Google® Analytics. If you do not want your data collected with Google Analytics, you can install the Google Analytics opt-out browser add-on. This add-on instructs the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) running on websites to prohibit sending information to Google Analytics. To opt out of Google Analytics, visit the Google Analytics opt-out page . For more details on installing and uninstalling the add-on, please see the relevant help resources.
● You also can choose to limit behavioral advertising by Google by going to https://www.google.com/settings/u/0/ads?sig= ACi0TCjxHuyl7Ig2gbFrnoQXZCdjgn620jCnrCrgZ5UORYoQpfdghVOTzs_2QLn2PMpTMhUVw3eDvXKe_6-QxXdYUU1L_mILnQ&hl=en and opting out of interest-based ads on Google.
● To opt out from ads from certain vendors in addition to Google, go to https://www.aboutads.info/ or http://optout.networkadvertising.org/?c=1. After you opt out, you will still see advertisements when you are online, but the advertising may not be as relevant to your interests. If you change your computer, change your browser, or delete your cookies, you will need to renew your opt-out.
Rights of California residents
Storage of information
· We store all information that we collect through the App on your Mobile Device and on servers operated by third parties. These servers are currently located in the United States, but in the future, they may be located in other countries and jurisdictions. You consent to have your PII, and the other information that may be collected when you use the App collected, stored and processed in the App on your Mobile Device and on servers in the United States and other countries and jurisdictions. If you back up your personal data on your Mobile Device, then you consent to have your PII stored and processed on the servers and other devices you choose for that purpose.
· Some Service Providers may automatically retain and store on their own servers data that they collect when you use the App.
Transfer of information
· We may transfer information that we collect about you, including PII, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
Management of information
· We will retain your PII for as long as you have an account in the App.
· To keep your PII accurate, current, and complete, log in and change it, or contact contact@wayoworld.com.
· You have the right to have us provide you with a copy of your PII that we process or control or to require that it be erased from the App user database. Please note, though, that if you ask us to delete your PII from the user database, we may not be able to provide you with some or all of the features that the App offers.
Protection of information
· All API calls from your computer and/or Mobile Device to the Wayo servers are encrypted.
· You are responsible for maintaining the privacy of your unique password and account information and for controlling access to your communications from the App at all times.
· Although your PII will be stored in secure third-party data centers, we cannot (i) ensure or warrant the security of any information that you store on the App (or any PII that you transmit when you use the App) or (ii) guarantee that information stored on or transmitted through the App may not be accessed, disclosed, altered, or destroyed. If any PII under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation, and where applicable, we will notify those individuals whose information may have been compromised and take other steps, in accordance with any App and the applicable laws and regulations.
No responsibility for third parties
· We are not responsible for the collection, use and disclosure policies and practices (including the data security practices) of other organizations, or any other applicable developer, provider, operating system provider, wireless service provider or device manufacturer, including for any PII you disclose to other organizations through or in connection with the App.
· So, for example, if you communicate directly with a restaurant or bar that you find through the App, Wayo is not responsible for how that restaurant or bar may use your PII.
Children (for parents)
· The collection, use, and sharing of PII from any user under 13 (a “child”) is governed by the Children’s Online Privacy Protection Act (“COPPA”).
· If your child creates an account on the App and indicates that he or she is under 13 years old, then we will (i) collect no PII or limited PII (e.g. email address only) from your child, as permitted by law, (ii) inform your child that we must have a parent’s verifiable consent before the child can participate in any activity on the App, and/or (iii) ask the child for a parent’s email address in addition to the child’s own email address.
· If the child provides your email address, we will use it to send you an email in which we seek your verifiable consent or notify you that your child wishes to use the App enable you to access and delete any PII that your child may have provided to us. In the email, we will explain what PII we are collecting, how we plan to use it, how you can give consent, and how you can revoke consent. If we do not receive your consent within a reasonable time, we will delete your contact information and any other PII that we have collected from your child. If the child does not provide your (or another parent’s) email address, we will delete the child’s PII.
· If you give consent for us to collect your child’s PII, once you give that consent, we may use any PII that we obtain from your child consistent with the rest of this Privacy Policy and/or the terms of the consent that you have provided. If you would like to review any PII that we have collected online from your child, have that PII deleted from our active servers, and/or request that there be no further collection or use of your child's PII, or if you have questions about these information practices, you may contact us at contact@wayoworld.com.
· We will not condition your child’s participation in any online activity on the disclosure of more PII than is reasonably necessary to participate in the activity.
· We will not use any email address that you have provided for parental consent purposes to market to you unless you have expressly opted in to receive marketing communications or you have separately participated in an activity that permits such email contact.
· If we discover that we have collected PII from your child in a way that is inconsistent with the requirements of COPPA, we will immediately either delete that PII or seek your consent for the collection, use and sharing of that PII.
Changes to this privacy policy
· You will see an in-app notification or receive an email (if we have your email address) if our practices concerning the collection, storage, use or disclosure of PII and other information change in a material way.
· This privacy policy was revised on July 10, 2023.
